Education and Children’s Services Act 2019

The Education and Children’s Services Act 2019 (the Act) passed Parliament on 1 August 2019.

Once in force, the Act will replace the Education Act 1972 and the Children's Services Act 1985. It will provide a contemporary framework for the delivery of high-quality children's services and compulsory education in South Australia.

Regulations to support the Act

We released draft Education and Children’s Services Regulations 2020 to support the implementation of the new Act for public consultation via the South Australian Government’s YourSAy website on 25 February 2020. 

Consultation on the draft regulations closed 5pm 3 April 2020.

Thank you to everyone who provided feedback. All feedback will be carefully considered in finalising the regulations.

The regulations will guide how our schools, preschools and children’s services operate and set out conditions of employment for government teachers. 

Some of the regulations will also deal with matters relevant to non-government schools and providers of approved learning programs.

The regulations will come into operation later in the year, at the same time as the Education and Children’s Services Act, which is currently available to view and download on the South Australian Legislation website

During the coming months, the Department will also be working with stakeholders to develop and update the policies that support the new legislation.
